§1 Preliminary Provisions

1.1 The online store available at www.untamedbrand.com is operated by UNTAMED Sp. z o.o., located at Azalii 10 street, 45-940 Opole, Poland. The company is registered in the National Court Register under number 0000823349, with VAT ID: 9910532052. You can contact the Seller via email: shop[@]untamedbrand.com.
1.2 The Seller provides services electronically in accordance with the Polish Act of July 18, 2002 on the Provision of Electronic Services (Journal of Laws 2017, item 1219, as amended).
1.3 Access to the online store is free and available to all users with an internet connection, subject to these Terms and Conditions.
1.4 Before using the store, the Buyer is required to read these Terms and Conditions. The Seller provides the Terms free of charge in a downloadable and printable format.
1.5 By registering an account in the store, the Buyer confirms that they have read, understood, and accepted the Terms and Conditions. The Buyer agrees to comply with its provisions.
1.6 Definitions:

  • Postal Address – full name or company name, street name, building and apartment number (if applicable), postal code, and city.

  • Returns & Complaints Address: UNTAMED Sp. z o.o., ul. Azalii 10, 45-940 Opole, Poland.

  • Shipping Rates – available on the website, listing delivery methods and their costs.

  • Delivery – shipping method, carrier, and cost as listed in the Shipping Rates.

  • Proof of Purchase – invoice, receipt, or other sales document in accordance with applicable VAT regulations.

  • Product Page – individual subpage with detailed product information.

  • Business Client – an individual or entity purchasing for business or professional purposes.

  • Civil Code – Polish Civil Code (April 23, 1964).

  • Code of Good Practice – industry standards as defined by the Polish Act on Counteracting Unfair Market Practices.

  • Consumer – individual purchasing not related to business or professional activities.

  • Shopping Cart – list of products selected by the Buyer.

  • Buyer – any Consumer or Business Client.

  • Delivery Address – location provided by the Buyer for order delivery.

  • Delivery Moment – the moment the Buyer or authorized person receives the goods.

  • Payment – method of payment selected by the Buyer.

  • Consumer Law – the Polish Consumer Rights Act (May 30, 2014).

  • Product – the smallest unit of goods available for purchase.

  • Subject of the Contract – the product(s) and delivery being purchased.

  • Pickup Point – delivery point not being a postal address.

  • Goods – physical item(s) available for sale.

  • Store – the e-commerce platform available at www.untamedbrand.com.

  • System – IT infrastructure supporting the online store.

  • Order Fulfillment Time – processing time listed on the Product Page.

  • Contract – agreement between Buyer and Seller via the Store.

  • Defect – physical or legal fault as defined by applicable laws.

  • Order – Buyer’s declaration of intent to purchase goods.

§2 Technical Requirements

2.1 Contracts are concluded in Polish and under Polish law unless otherwise specified.
2.2 The delivery address must be located within the Republic of Poland.
2.3 The Seller agrees to supply defect-free products.
2.4 All prices are quoted in Polish złoty (PLN) and include VAT. Shipping costs are listed separately.
2.5 Deadlines are calculated in accordance with the Civil Code.
2.6 The Seller provides confirmation and contract documents via: a) Email confirmation with order summary, pro forma invoice, withdrawal form, and PDF version of the Terms. b) Printed invoice and return documentation included with the order.
2.7 Product warranties by third parties are disclosed if applicable.
2.8 The Seller does not charge extra for digital communication. Buyers cover their own internet/service provider costs.
2.9 The Store supports the latest versions of major browsers (Chrome, Firefox, Safari, Edge, Opera). Use of third-party plugins may impact store functionality.
2.10 Buyers may save their login details for faster checkout. Secure credentials are the Buyer’s responsibility.
2.11 The Seller adheres to the applicable Code of Good Practice.

§3 Order Process

3.1 Orders can be placed 24/7.
3.2 Steps to place an order: a) Add products to cart; b) Select shipping method; c) Choose payment method; d) Provide delivery address; e) Confirm order via “Place Order” button.
3.3 A contract with a Consumer is concluded upon order submission.
3.4 For cash-on-delivery orders, fulfillment begins immediately. For prepaid orders, processing starts after payment is received (within 5 days unless otherwise agreed).
3.5 A contract with a Business Client is concluded upon order acceptance, confirmed by the Seller within 48 hours.
3.6 Fulfillment timelines depend on payment confirmation.
3.7 The Seller may require full or partial prepayment, or offer credit/payment on delivery subject to approval.
3.8 Shipping time is stated on the Product Page. For multiple items, the longest lead time applies.
3.9 Orders are delivered with the invoice and return documentation.
3.10 For card payments, delivery time starts upon successful authorization.

§4 Right of Withdrawal

4.1 Consumers have the right to withdraw from a distance contract within 14 days without giving a reason. 4.2 The withdrawal period starts upon receiving the goods.
4.3 The withdrawal form is available on the site or may be submitted in any form.
4.4 The Seller will confirm receipt of the withdrawal statement by email.
4.5 Upon withdrawal, the contract is considered void.
4.6 The Buyer must return the goods within 14 days.
4.7 Returns are at the Consumer’s cost and risk.
4.8 Digital content delivered electronically is refundable only if specific consent was not given.
4.9 Consumers are liable for any reduction in value due to improper use.
4.10 Refunds will be processed within 14 days, including original shipping (excluding premium delivery upgrades).
4.11 Refunds will be made using the same payment method, unless otherwise agreed.
4.12 Refunds may be withheld until the Seller receives the goods or proof of return.
4.13 The right of withdrawal does not apply to: a) Price-fluctuating items; b) Custom-made or personalized goods; c) Perishable items; d) Sealed goods unreturnable for hygiene reasons once opened; e) Items inseparably mixed with others; f) Sealed audio/video/software once opened; g) Digital content delivered with prior consent; h) Newspapers, magazines (except subscriptions).
4.14 For card payments, refunds are processed back to the original card.

§5 Warranty

5.1 The Seller excludes warranty liability for Business Clients.
5.2 For Consumers, statutory warranty rights apply under the Civil Code.

§6 Privacy Policy & Data Protection

6.2 Personal data is processed based on consent and for contract fulfillment. Data may be shared with service providers (e.g. IT support).
6.3 Buyers have the right to: withdraw consent, access, correct, delete, limit, object, and transfer their personal data. Full rights are outlined in the Privacy Policy.
6.4 Data is protected according to applicable laws. Complaints may be submitted to the Data Protection Authority.

§7 Final Provisions

7.1 None of the provisions of these Terms infringe upon Consumer rights. Any invalid provision will be replaced by one consistent with the law.

7.4 In disputes involving Business Clients, the court with jurisdiction over the Seller’s registered address shall apply.
